Terms & Conditions Of Agreement
1. Customer Declarations:
I declare that
1.1 I am over the legal age of 18 years.
1.2 I am one of the registered owners of the property at the installation address and my name is on the title deed of the Installation Address.
1.3 I have never received or have never been approved for any rebate, financial assistance solar credit or small scale technology certificate (STCs) for small generation solar power system at the Installation Address.
2. Payment Policy
2.1 The Customer agrees to pay Solar Miner the balance as set out in Payment Policy section on the date of completion of the solar system. The solar system will remain the property of Solar Miner unless it is paid for in full. Solar Miner reserves the right to remove. Solar panels inverters and other parts installed if the payment is failed to be received in the prescribed time frame after solar system installed.
2.2 If customer fail to pay any amount that is due and payable under this agreement, Solar Miner will be entitled to charge interest on the unpaid amount at the current Reserve Bank target cash rate plus 3%. You will also have to pay Solar Miner any costs associated with the recovery of such unpaid amounts.
3. STC incentive :
3.1 You are agreeing to pay Solar Miner the STC’s as part payment for your system. The STC’s will be paid directly to Solar Miner or a Solar Miner Agent. If the Office of Clean Energy Regulator (http://ret.cleanenergyregulator.gov.au/) determines you are not eligible to receive STC’s, and therefore Solar Miner is unable to receive the STC’s as part payment, you will be liable to pay Solar Miner the value of the STC’s, as determined by market rates.
3.2 You acknowledge that if you breach any conditions of the STC’s incentive regulations, you may be financially liable to the Office of Clean Energy Regulator. (http://ret.cleanenergyregulator.gov.au/). If you commit any breach of the Incentive Regulation, you acknowledge that Solar Miner will not be liable to you.
3.3 Solar Miner or a Solar Miner Agent will arrange for the complete documentation and processing of the sale of STC’s. You acknowledge that the price of STCs is governed by market movements and the REC guidelines. If the market price falls below a certain price, Solar Miner may decide to delay the installation until the price rises to a higher level. Solar Miner may also refuse to carry out installation and refund your complete deposit. If the market price follow below the certain price, as determined by Solar Miner at its absolute discretion.
3.4 If Solar Miner does not receive payment for the STCs, for any reason whatsoever, you are required to pay the amount owing within 14 days from the day of the receipt of notice. Your purchase price includes a point of sale discount on the condition that you agree to assign the right to create STCs to Solar Miner.
4. Access to property: You authorise Solar Miner and its contractors, employees and installers. Full access to the property at all reasonable times to carry out all work associated with the installation of your solar system including site Inspections, the signing of required paperwork, the delivery and installation of the PV Solar system, and connection to the grid. Your co-operation is required for site inspections/installation to occur at the earliest possible time which is convenient to Solar Miner.
5.1 The ownership and insurance risk of the PV solar system passes to you upon installation and Solar Miner receiving full payment for the solar system. It is your responsibility to ensure that your property insurance adequately covers the cost of your PV solar system.
5.2 Consumer need to contact their electricity retailer or relevant State or Territory government before sign this contract In regards to feed in tariff , their electricity contract/tariff may change, following installation of solar and that the consumer should contact their electricity retailer : the “feed in tariff incentive” as administered by the relevant State or Territory government. Consumer needs to check before signing a contract, to check what new electricity tariff rates may be applied; and after installation of the solar PV system, to confirm that the agreed tariff has been applied.
5.3 All Solar Miner installers are subcontractors who are required by Solar Miner to have appropriate third party damage insurance, under relevant state and territory laws. Solar Miner will work with you and the installer to rectify any damage caused to your property by the installer’s negligence.
5.4 consumer acknowledge that old and brittle roofing tiles that may be cracked or damaged during installation. Customer needs to provide same spare roof tiles on the day of installation so installer can replace same time.
5.5 You acknowledge Solar Miner accepts no liability or responsibility for your STC’s incentive as administered by the Office of Clean Energy Regulator (http://ret.cleanenergyregulator.gov.au/).
6. Delivery and Installation: estimated time frame for supplying and installing the system is within 4 weeks’ time of contract signed, installation time frame is depends on subject to approval from local gird connection approval , other authorities approval ( body corporate, local state govt approval if needed) and property travel distance and transportation.
7. Meter box upgrades and Additional Costs
7.1The customer acknowledges that any electricity provider compulsory meter box upgrade required to the customer’s property is not included in this Agreement. The customer may choose to utilise the electrician providing the solar installation at extra cost for meter box upgrade or via the customer’s own resources. Anything regarding about Smart Meter Installation & Smart Meter Programming required to customer’s property is not included in this agreement. If the existing switchboard and/or electrical infrastructure at the installation address, or any other surfaces or structures where the System is to be installed, do not comply with all relevant legal requirements (including all relevant codes and regulations) you may need to repair, replace or upgrade those at your own cost prior to the installation. the consumer will get full refund upon request when extra chargeable work arises, which was not specified in the initial contract, and the additional costs are not borne by the Signatory and the consumer does not consent to these additional costs.
7.2 Solar Miner will not be liable for any unexpected costs which may arise in relation to the removal and handling of asbestos at your property in relation to the installation of the solar system.
7.3 If customer is connected with any Electric Hot water/Slab Heating/Climate Saver/Off Peak Meter then customers need to arrange wiring work at their own cost, including installation of timer/contactors/any amps switches to control the system. Solar Miner is not responsible to any costing for that and any delay comes during your grid connection process.
7.4 Home owner must be present during installation to sign the mandatory declaration assigning the STCs to SOLAR MINER, as per the renewable Energy Act (2000). Should the installer arrive on the agreed date and the home owner is not present, a rescheduling fee of $200.00 will apply and the installation will be delayed.
7.5 In regards to any preference regarding panel/Inverter placement, you are required to inform the installer when they arrive on property. Solar Miner does not permit any subsequent changes, modification or reinstallation of the installed system.
8. Warranties: Solar Miner provide the customer with a 5 year warranty on the operation and performance of the entire system – including workmanship and products, within the Guarantee Period, including by replacing all or part of the System where necessary, within a reasonable timeframe at no cost to you, The system comes with up to 10 year’s installation warranty from Solar Miner in conjunction with the manufacturer’s warranty. the consumer’s rights under the warranty sit alongside the consumer guarantees which are required under ACL and cannot be excluded.
9. Termination & Refund Policy:
9.1 If customer has paid us money under this agreement, but the agreement ends for any of the following reasons before we install the System at your Premises, then when the agreement ends we will promptly refund all of the money you have paid: (a) if we have not delivered and installed the System at the Premises within 4 weeks of contract signed and you choose to end the agreement. or (b)Grid Connection Approval is refused. (c)If any of the equipment quoted is unattainable and you do not agree to equipment of a similar quality to be substituted. (d) the consumer will get full refund upon request when extra chargeable work arises, which was not specified in the initial contract, and the additional costs are not borne by the Signatory and the consumer does not consent to these additional costs.
9.2 Customer have right to cancel this agreement within 10 business days from and including the day after you signed or received this agreement. The Customer may terminate this agreement by delivering written notice of termination here of to Solar Miner, the consumer can cancel the agreement within 10 business days without penalty.
9.3 Solar Miner may terminate any agreement to supply a system should the government incentives or other benefit, including STCs, be reduced, discontinued, withdrawn or cancelled prior to the installation of your System. If Solar Miner does terminate the sale for this reason you will be entitled to a full refund.
10 Other Terms : (a) Any requirement to provide a document or information in writing can be met in electronic form, or to provide a signature can be met in electronic or verbal form. (b) In addition to this agreement, various laws and codes, including the Australian Consumer Law and, if we have volunteered to be bound by it, the CEC Solar Retailer Code of Conduct, also contain rules applicable to the sale and installation of solar photovoltaic systems, and we will comply with these rules in selling you the System and installing it at the Premises.
